In a typical real estate transaction, a purchaser will present an Offer to Purchase to a seller. This is the most important contract in any potential real estate transaction. An Offer to Purchase stands as a contract even after the closing has taken place. What is contained in that contract is vital to any seller. There are implied warranties that you may not even be aware you are giving to your purchaser. Having an attorney review any Offer to Purchase prior to signing is your insurance policy against future liabilities.

In a real estate transaction, a seller is responsible for providing among other things, Title Insurance, Deed with Electronic Real Estate Transfer Receipt and a Closing Statement. Hiring an attorney to assist you takes the worry out of how to provide these documents. You simply have to show up at the closing.

Having an attorney by your side in a real estate closing in which you are selling your real estate will alleviate any worry or pressure involved in seeing that the transaction closes smoothly. The attorney will handle any unknown issues that may arise, such as a cloud on title, unknown liens or any encroachments.
