The Probate Process in Waupun

Probate is the process of managing and distributing a lost loved one's estate according to state law or the decedent's will. A normal probate process includes filing paperwork with the court, along with presenting the original copy of the deceased's will. The estate must then be collected, inventoried, and taxes and debts must be paid. If the decedent did not have enough money to pay said taxes or debts, parts of the estate may need to be sold. In order for the probate court to close the estate, the personal representative must distribute the deceased's assets according to their will. If the decedent did not have a valid will, the personal representative must divide their estate according to Wisconsin law. Informal & Small Estate Probate in Dodge & Winnebago Counties

Informal probate is the administration of a decedent's estate without the probate court's supervision. Informal administration proceedings are Circuit Court proceedings under probate jurisdiction, and are managed by the Probate Registrar. A personal representative may use informal probate if he or she chooses no matter the value of the assets in the estate and the will does not state that informal probate is prohibited. Summary proceedings and Transfer by Affidavit are available for estates having a value of $50,000 or less.

Although the decision of administering the estate by informal probate procedure is made by the personal representative, any beneficiary or party may petition the court for formal administration at any point during the probate process if they file an objection. When a person who has a Will dies, the Will must be filed with the Court. However, the State of Wisconsin does allow the transfer of an estate with less than $50,000 to an interested person of the deceased without going through the normal probate process.
